An issue came up with a new listing I have. The Strata Bylaws specificlly state that Real Estate signs are prohibited on Common property of the strata.
This is in violation of the Strata Property Act which states:
Unenforceable bylaws
121 (1) A bylaw is not enforceable to the extent that it
(a) contravenes this Act, the regulations, the Human Rights Code or any other enactment or law,
(b) destroys or modifies an easement created under section 69, or
(c) prohibits or restricts the right of an owner of a strata lot to freely sell, lease, mortgage or otherwise dispose of the strata lot or an interest in the strata lot.
Bylaws relating to sale of strata lot
122 The strata corporation may pass a bylaw governing activities relating to the sale of a strata lot, including locations for the posting of signs and times for the showing of common property and holding of open houses, but the bylaw may not prohibit or unreasonably restrict those activities.

My client asked that I put up a sign and I informed her of the existing bylaw and also of her rights under the Strata Property Act. She asked me to put up a sign and see what happens. The next day I received a very polite email from the president asking me to take it down. I did take the sign down as asked but also sent an email advising the council that they were violating the Strata Properties Act and to advise me where I could place the sign.
After reading my email and the act council advised me to return my sign and that they would be amending the bylaws.
The key here is to make sure you have an experienced REALTOR on your side to properly advise you of your rights. Street signs are still very effective advertising tools. People who live and work in your area should be aware that there is a suite for sale in your building as this is where they are likely to buy.
